Terms of Service

Please read these Terms of Service carefully before using Talentlinq. They constitute a legal agreement between you and Talentlinq Ltd.

1. Acceptance of terms

By accessing or using Talentlinq, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our service. These terms apply to all users of Talentlinq, including employers who create accounts and candidates who submit interview responses via unique links.

2. Description of service

Talentlinq provides an async video interview platform. Employers may create job listings, invite candidates via unique links, and review recorded video responses through a web-based interface. Candidates may record and submit video answers without creating an account.

3. Accounts

You must be at least 18 years old to create an employer account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorised access. Talentlinq is not liable for any loss resulting from unauthorised use of your account.

4. Acceptable use

You agree not to use Talentlinq to: - Discriminate against candidates on the basis of any protected characteristic - Collect video responses for purposes other than legitimate employment screening - Harvest, scrape, or misuse candidate data - Upload content that is unlawful, harmful, threatening, or defamatory - Attempt to reverse-engineer, disrupt, or gain unauthorised access to the platform - Violate any applicable local, national, or international law or regulation

5. Candidate data and consent

Employers are responsible for ensuring that candidates are informed that their video responses will be recorded and reviewed. Employers must have a lawful basis for processing candidate data under applicable data protection law (e.g. GDPR, UK GDPR). Talentlinq provides the platform; the employer is the data controller for candidate responses.

6. Intellectual property

Talentlinq retains all intellectual property rights in the platform, its design, and underlying technology. You retain ownership of content you create (job listings, questions). By uploading candidate video responses to Talentlinq, candidates grant the employer a limited licence to view and evaluate those responses for hiring purposes.

7. Subscriptions and billing

Paid plans are billed monthly through Stripe. You authorise us to charge your payment method on a recurring basis. You may cancel at any time from your billing settings; cancellation takes effect at the end of your current billing period. We reserve the right to change pricing with 30 days' notice to registered users. Continued use after a price change constitutes acceptance. Refunds are at our discretion and are not automatically provided for partial months or unused features.

8. Free trial

Talentlinq offers a 7-day free trial. No credit card is required to start a trial. Trial accounts are subject to the Free plan limits. We reserve the right to modify or end the free trial offer at any time.

9. Service availability

We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects the service and will endeavour to minimise disruption. We are not liable for losses arising from service interruptions.

10. Limitation of liability

To the maximum extent permitted by law, Talentlinq is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the platform. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Talentlinq harmless from any claims, losses, or damages (including legal fees) arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for material breach of these terms, non-payment, or illegal conduct. You may delete your account at any time from your settings. Upon termination, your data is deleted according to the retention schedule in our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time. We will notify registered employers by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the updated terms.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
